Terms and Conditions
1.0 RETURN POLICY.
1.1 The customer is required to report shipping damage to any items immediately upon receipt. All item(s) are subject to a seven-day return policy. Seven days after the customer’s receipt of the item, the customer is obligated to either return the item(s) with proof of purchase (at the customer’s own expense, unless the item(s) was eligible for free returns) or the sale will be considered final. Houghton Horns LLC (“Seller”) must be notified by phone or email that the customer wishes to return the item(s) before sending it back.
1.2 If the item(s) is returned in accordance with this policy, Seller will process a full refund after it is inspected and declared to be in the same condition in which it was shipped to the customer. If the free shipping option was utilized, Seller’s shipping and handling costs will be deducted from the refund unless the item(s) was eligible for free returns. If the instrument is determined by Seller to have been damaged by the customer, repair and depreciation costs will be deducted from any refund. The customer is responsible for any damage that may have occurred in transit back to Seller. Seller encourages the customer to purchase shipping insurance.
1.3 No returns will be accepted, nor refunds given for item(s) ordered, shipped or carried outside of the United States of America.
1.4 No returns will be accepted, nor refunds given for item(s) upgraded or customized by seller at the request of the customer.
1.5 No returns will be accepted, nor refunds given for item(s) that have been special ordered at the request of the customer.
1.6 No returns will be accepted, nor refunds given for maintenance accessories (cleaning snakes, polishing cloths, oils, etc.)
1.7 No returns will be accepted, nor refunds given for stretched and/or deformed leather hand guards or straps.
1.8 No returns will be accepted, nor refunds given for print and recorded media (including sheet music).
1.9 No returns will be accepted, nor refunds given for clothing that has been stained, worn, or washed.
1.10 Mouthpieces that show any signs of use (worn shank, scratches, dings, dirt, etc.) may be subject to a restocking fee up to 25%.
1.11 The customer is responsible for abiding by the terms and conditions of any financing contract signed with a third-party financial institution such as Affirm, First Financial Bank, Synchrony, or the Musician’s Federal Credit Union. Even if the item(s) are returned within the 7-day trial period, the customer may be responsible for any payments, interest, or other fees that accrued during the duration of their financing contract with the third party.
2.0 PAYMENT AND TITLE.
2.1 Payment is accepted and processed when the order is initially placed unless the customer is utilizing financing through the Musicians Federal Credit Union (“MFCU”). If the customer is utilizing financing through the MFCU, seller must receive full payment from the MFCU within one week of the order.
2.2 Orders will be shipped within 3 business days of full payment.
2.3 The customer will be charged a $50 fee for each returned check.
2.4 We will only accept personal checks up to $5000.
2.5. Checks must be presented and signed in person (no mailed checks).
2.6 No checks will be accepted without the presentation of a valid driver’s license or state ID.
2.7 Checks with a PO Box will not be accepted.
2.8 Temporary checks will not be accepted.
2.9 Checks numbered under 300 will not be accepted.
2.10 Post-dated checks will not be accepted.
2.11 We will not agree to hold a check for any length of time.
2.12 Title to the item(s) transfers to Customer upon receipt of payment to Seller.
2.13 If an item(s) is sold on credit, customer acknowledges that Seller retains a purchase money security interest in the item(s).
3.2 Seller uses secure methods to process financial transactions.
4.1 If the customer is trading in an instrument the customer certifies that it has full power, right and lawful authority to dispose of the trade-in and that the trade-in is not subject to any liens or encumbrances.
5.0 SPECIAL ORDERS.
5.1 Special orders for items seller does not normally stock as determined by seller at the time of order cannot be returned or exchanged.
5.2 A 25% non-refundable deposit is required to place a special order.
5.3 Special orders for items we normally stock are refundable according to that item’s category listing in our Terms and Conditions. A fully-refundable 25% deposit is still required to place the order.
5.4 The balance of the invoice is due when we receive notice from the supplier/manufacturer that the item is ready to be shipped to us.
6.1 Items ordered via “Local Pickup” must be retrieved from Houghton Horns within 7 days or the order will be cancelled and the customer refunded. If there are special circumstances and you need us to hold an item longer, please contact us.
6.2 Seller does not guarantee delivery dates for any shipping method.
6.3 When the customer requests free shipping or a domestic ground shipping service, orders will be processed within 3 business days. Items shipped to the 48 contiguous U.S. states should arrive in 3 – 7 business days depending on delivery location. Items shipped to Alaska, Hawaii, and other U.S. territories and possessions will take an additional 2 – 6 business days for delivery.
6.4 Orders from outside the contiguous 48 states are excluded from free shipping promotions with the exception of military addresses. Due to carrier size restrictions not all items are available for shipment to military addresses. Free shipping promotions are not available for pre-owned instruments, tubas, and other large, heavy, or bulky items.
6.5 When the customer requests a domestic expedited shipping service, orders will be processed within 1 business day. Items shipped to the 48 contiguous U.S. states should arrive in 1 – 3 business days depending on delivery location. Items shipped to Alaska and Hawaii will take an additional 2 – 4 business days for delivery.
6.6 International (including U.S. Territories) shipping is available. Shipping time frames are dependent on various factors such as items selected, shipping destination, and the shipping method selected. No returns will be accepted nor refunds given for orders that were initially shipped outside of the United States of America.
6.7 Any customs and duties charges are the responsibility of the customer. Please consult your local postal service or customs office if you have questions about the customs and duties that may be imposed on your purchase.
7.1 CUSTOMER ACKNOWLEDGES AND ASSUMES ALL RISKS INHERENT IN THE USE OF THE INSTRUMENT(S). CUSTOMER AGREES TO REIMBURSE, DEFEND, INDEMNIFY AND HOLD SELLER HARMLESS FROM AND AGAINST ANY AND ALL LIABILITY, LOSSES, INJURIES, DEMANDS, COSTS, EXPENSES, FINES, SETTLEMENTS, PENALTIES, CLAIMS AND DAMAGES OF ANY KIND (INCLUDING ATTORNEYS’ FEES) OF ANY KIND OR NATURE (“CLAIMS”) ASSERTED BY ANY PERSON OR BY OR BEFORE ANY GOVERNMENTAL ENTITY ARISING OUT OF THE PURCHASE, USE, MAINTENANCE OR OWNERSHIP OF THE INSTRUMENT(S), HOWEVER CAUSED OR RELATED IN ANY OTHER WAY TO THESE TERMS, EXCEPT TO THE EXTENT THOSE CLAIMS ARE THE RESULT OF SELLER’S NEGLIGENCE.
8.1 Customer agrees to conduct business electronically. Customer acknowledges that its electronic signature has the same validity and meaning as a handwritten signature.
8.2 This agreement and all matters regarding the interpretation and/or enforcement hereof, will be governed exclusively by the laws of the State of Texas. All disputes arising in connection with this agreement will be submitted to the jurisdiction of the courts in Tarrant County, Texas
