How It Works

Whether you visit us in person or ship your instrument, the consignment process is straightforward.

Schedule an Appraisal

Schedule an appointment to bring the instrument in for an appraisal. We will quote you an estimated sale price for free.

Sign the Agreement

Once we have tentatively agreed on a sale price, we will email you a DocuSign contract of our consignment agreement. Please fill it out before you release the instrument to us.

Cleaning & Prep

You will need to pay for an ultrasonic cleaning. We will contact you via phone or email for approval if further repairs are needed to get the instrument into salable condition.

Listing & Display

We will photograph your instrument, add it to our website, and display it in our showroom and at music shows. We appreciate your patience, as this may take a month, depending on the availability of our repair technicians and photographer.

Get Paid

Approximately four weeks after the sale of your instrument we will contact you to send you an e-payment for the sale price of the instrument minus the consignment fees.

Ship Your Instrument

Ship the instrument to Houghton Horns, 137 Hill St., Keller, TX 76248. Include the signed consignment agreement in the box so we can identify the instrument. Please remove mouthpieces, cleaning supplies, and other accessories from the case — these will not increase the sales price but can bounce around and damage your instrument during shipping.

Agreement Summary

Exclusive Right to Sell
Houghton Horns has the exclusive right to sell your instrument. You deliver it to us, and we both agree on the sales price.
Payment & Proceeds
Houghton Horns charges a consignment fee. After the fees, you'll get the net proceeds within 30 days after the buyer's return/trial period. You'll get a link to sign up for electronic payment via BILL, our accounting software. We recommend using this method. If you ignore the link, BILL will send a paper check. There's a $25 fee for reissuing lost checks.
Loss & Insurance
Houghton Horns is responsible for any loss or damage while the instrument is in our care, and we'll maintain insurance to cover replacement costs.
Termination
Either party can end the agreement with written notice. If you end it within three months, there's a $100 fee. Houghton Horns can end the consignment if the instrument doesn't sell within a year, except for specialty instruments. You'll pay for any unpaid services and return shipping if the consignment ends without a sale.
Instrument Preparation
Houghton Horns may take about one to four weeks to prepare the instrument before posting photos on our website. We require all instruments to be in "good" or better condition, as determined by us. We can perform the necessary services, which you'll pay for upon completion.

I. Right to Sell

The Consignor grants Houghton Horns LLC an exclusive right to sell the Instrument under the terms of this Agreement. The Consignor agrees to deliver to Houghton Horns LLC, on consignment, the Instrument. All sales prices and terms of sale shall be determined by mutual consent of the parties.

II. Proceeds of Sales

Houghton Horns LLC shall charge a consignment fee of the agreed-upon percent of the proceeds from the sale of the Instrument. Payment of the net proceeds from the final sale, after deducting applicable fees, shall be made to the Consignor within thirty (30) days following the conclusion of the buyer's trial/return period.

The Consignor is encouraged to opt for electronic payout via BILL. If the Consignor disregards the invitation, a paper check will be mailed. Houghton Horns LLC shall not be liable for any loss from paper checks. A $25 fee applies for reissuing checks.

III. Title to Merchandise

Consigned merchandise shall remain the property of the Consignor until sold.

IV. Loss and Insurance

Houghton Horns LLC shall be responsible for all shortages, loss, or damage while the merchandise is under the control of Houghton Horns LLC. Houghton Horns LLC shall maintain insurance in adequate amounts to pay for replacement.

V. Payroll Taxes

Houghton Horns LLC shall be exclusively liable for all employee payroll taxes and insurance arising out of wages payable to persons employed by Houghton Horns LLC in connection with this Agreement.

VI. Dispute Resolution

The parties will attempt to resolve any dispute through friendly negotiations. If unresolved, the dispute will be submitted to mediation. If mediation is not successful, outstanding issues will be submitted to binding arbitration under the rules of the American Arbitration Association.

VII. Warranties

Neither party makes any warranties with respect to the use, sale or other transfer of the Instrument by the other party or any third party. The Consignor will not be liable for direct, indirect, special, incidental, or consequential damages related to the Instrument.

VIII. Transfer of Rights

This Agreement shall be binding on any successors. Neither party may assign its interests without prior written consent of the other party.

IX. Termination

This Agreement may be terminated by either party with written notice. A $100 fee applies if the Consignor terminates within three (3) months. Houghton Horns LLC may terminate if the Instrument does not sell within one (1) year, except for specialty instruments (single horns, descant horns, triple horns, natural horns, right-handed horns, rotary trumpets, alto trombones, etc.).

If consignment concludes without a sale, the Consignor is responsible for any unpaid cleaning/repair costs and the cost of returning the Instrument.

X. Entire Agreement

This Agreement contains the entire agreement of the parties and supersedes any prior written or oral agreements.

XI. Amendment

This Agreement may be modified or amended if the amendment is made in writing and signed by both parties.

XII. Severability

If any provision is held invalid, the remaining provisions continue in effect. Courts may limit invalid provisions to make them enforceable.

XIII. Waiver

Failure to enforce any provision shall not waive that party's right to subsequently enforce strict compliance.

XIV. Applicable Law

This Agreement shall be governed by the laws of the State of Texas.

XV. Preparation of Instrument

Houghton Horns LLC may take one (1) to four (4) weeks to prepare the Instrument for sale. All consigned instruments must be brought to "good" or better condition, as determined solely by Houghton Horns LLC. Payment for services is due upon completion.

XVI. Stolen Property

If Houghton Horns LLC becomes aware that any instrument has been reported as stolen, the instrument will be surrendered to law enforcement authorities. It will not be returned to the Consignor.
