Terms of service

In these terms, "Houghton Horns," "we," "us," and "our" refer to Houghton Horns LLC. "You" and "your" refer to the customer.

Payment and Title

Payment. Full payment is accepted and processed when you place your order. Two exceptions:

  • If you are using financing through the Musicians Federal Credit Union ("MFCU"), we must receive full payment from the MFCU within one week of the order.
  • If you are pre-ordering an instrument, we need a 25% deposit upfront to create the order, with the remaining 75% due when the instrument is complete.

We must receive full payment in advance to place a pre-order for any other product.

Checks. You will be charged a $50 fee for each returned check. We accept personal checks only up to $5,000, and only under the following conditions:

  • You must present a valid driver's license or state ID;
  • We do not accept checks with a PO Box address;
  • We do not accept temporary checks;
  • We do not accept checks numbered under 300;
  • We do not accept post-dated checks;
  • We will not agree to hold a check for any length of time.

Title. Title to the items transfers to you upon our receipt of payment. If we sell you items on credit or financing, you acknowledge that we retain a purchase money security interest in the items.

Pricing Errors. We will not process online sales of products that contain an obvious pricing error, such as a $0 price. When we discover a pricing error, we will cancel the sale of the products and return your money.

Trade-Ins and Consignments

If you are trading in or consigning an instrument, you certify that you have full power, right, and lawful authority to dispose of the trade-in and that the trade-in is not subject to any liens or encumbrances.

Indemnity

YOU ACKNOWLEDGE AND ASSUME ALL RISKS INHERENT IN THE USE OF THE INSTRUMENT(S). YOU AGREE TO REIMBURSE, DEFEND, INDEMNIFY, AND HOLD US HARMLESS FROM AND AGAINST ANY AND ALL LIABILITY, LOSSES, INJURIES, DEMANDS, COSTS, EXPENSES, FINES, SETTLEMENTS, PENALTIES, CLAIMS, AND DAMAGES OF ANY KIND OR NATURE (INCLUDING ATTORNEYS' FEES) ("CLAIMS") ASSERTED BY ANY PERSON OR BY OR BEFORE ANY GOVERNMENTAL ENTITY ARISING OUT OF THE PURCHASE, USE, MAINTENANCE, OR OWNERSHIP OF THE INSTRUMENT(S), HOWEVER CAUSED OR RELATED IN ANY OTHER WAY TO THESE TERMS, EXCEPT TO THE EXTENT THOSE CLAIMS ARE THE RESULT OF OUR NEGLIGENCE.

Miscellaneous

Electronic Business. You agree to conduct business electronically. You acknowledge that your electronic signature has the same validity and meaning as your handwritten signature.

Firearms and Weapons. Firearms and other weapons are not permitted inside any Houghton Horns building, including our showroom, repair shop, and performance hall. This applies to both open and concealed carry, and to both licensed and unlicensed carry. Pursuant to Texas Penal Code Sections 30.05, 30.06, and 30.07, we hereby provide notice that entry onto our property with a firearm is forbidden. If you arrive carrying a firearm, we ask that you secure it in your locked vehicle before entering.

Governing Law. This agreement, and all matters regarding its interpretation and/or enforcement, will be governed exclusively by the laws of the State of Texas. All disputes arising in connection with this agreement will be submitted to the jurisdiction of the courts in Tarrant County, Texas.
